Terms & Conditions

1.  Preamble

1.1  This website is owned and published by GG.COM Limited whose registered address is GG.COM Limited, Towcester Racecourse, London Road, TOWCESTER NN12 6LB and whose registered company number is 03995894. GG.COM Ltd is a registered company in England and Wales.

2.  Definitions

2.1  "GG.COM" is the interactive on-line service operated by GG.COM Limited on the World Wide Web of the Internet, consisting of information, services and content provided by GG.COM Limited, its affiliates and other third parties.

2.2  "Client" means each person who establishes or accesses a connection to GG.COM

2.3  "Information" means all or any part of the information and other content made available on the Service either provided by GG.COM Limited, its affiliates or other third parties.

2.4  "Service" means the GG.COM website pages from time to time available.

2.5  "Premium Pay Services" means services for which GG.COM levy a charge.

3.  General

3.1  The Client's use of GG.COM is governed by these terms and conditions and any other terms and conditions which appear on GG.COM in relation to specific Services provided by GG.COM. By using GG.COM the Client agrees to comply with all of the terms and conditions thereof.

3.2  GG.COM Limited shall have the right at any time to change or modify the terms and conditions applicable to the Client's use of GG.COM, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use.

3.3  Any changes, modifications, additions or deletions to the terms and conditions governing GG.COM shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the website, electronic or conventional mail, or any other means by which the Client obtains notice thereof. Any use of GG.COM by the Client after such notice shall be deemed to constitute acceptance by the Client of such changes, modifications, additions or deletions.

3.4  The Client is not required to register to use GG.COM in general, however, access to certain areas may require the Client to open an account with GG.COM by completing a registration form. The right to use the account is personal to the Client and the Client shall be responsible for protecting the confidentiality of its password, if any, and for ensuring that no unauthorised access is obtained to the Service. Client is fully responsible for all actions undertaken using the password for its account.

3.5  The Service is accessed via the Internet, 3G mobile Technology, Web TV or via any other media or platform on which GG.COM choose to operate. GG.COM Limited reserves the right to alter the Service at any time including content, hours of service, media platform as well as equipment needed to access the Service.

3.6  Payments - all credit card payments made for GG content through our partner bank, the merchant description GG COM will appear on the card statement.

3.7  If you experience any difficulties while attempting to access the Service, please contact us.

4.  Licence and Rights

4.1  GG.COM Limited is the owner of or has the right to provide the Information on the Service including use of intellectual property rights in the Service or the Information. GG.COM contains copyright material, trademarks and other proprietary information, including, but not limited to, text, software, photos and sound, and the entire contents of GG.COM is owned by GG.COM Ltd, its affiliates or licensors and is protected by copyright and trade mark laws. Racecard information is the copyright of The British Horseracing Authority. Any Breeding Information is the copyright of Weatherbys Group Ltd.

4.2  The Client may not copy, modify, reproduce, republish, transmit, distribute, or in any way exploit, any of the content of GG.COM, in whole or in part, without the express written permission of GG.COM Limited and/or the copyright owner. In the event of any permitted copying, redistribution or publication of copyright material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The Client acknowledges that it does not acquire any ownership rights by downloading copyrighted material. All other rights are reserved.

4.3  The Client may download the Information and view it on a single CPU and a single copy of its selected bought option can be printed out by the Client for its personal and private use only and not for any commercial exploitation.

5.  Warranties and Liability

5.1  Due to the nature of software and the Internet, no guarantee is given of uninterrupted or error free access to or running of GG.COM or the transactions conducted through it and GG.COM Limited shall not be liable for any failures due to software or Internet errors or unavailability or other circumstances beyond its control including, but not limited to, third party suppliers.

5.2  Whilst GG.COM Limited endeavours to ensure that the Information is accurate, complete and up to date, GG.COM Limited makes no representations or warranties, express or implied, regarding the Service and the Information and all representations, warranties, terms and conditions whether express or implied by statute, common law or otherwise are excluded to the fullest extent permitted by law.

5.3  GG.COM Limited warrants that all Premium Pay Services will be provided with reasonable care and skill and that it will use its reasonable endeavours to correct any errors in the delivery of those services as promptly as possible.

5.4  In the event that GG.COM Limited fails to comply with its warranty above having been given a reasonable opportunity to correct such failure, GG.COM Limited's aggregate liability to the Client for all losses, damages, costs, claims and expenses howsoever arising, shall not exceed the total charges paid by the Client in respect of the services in which such failure occurred.

5.5  In no event will GG.COM Limited be liable to the Client for any consequential or indirect loss or damage (whether for loss of profits or anticipated profits or gains, including loss of profits on contracts, business revenue, goodwill or otherwise) howsoever arising out of or in connection with the Service.

5.6  GG.COM may be linked to or from other websites that are not maintained by GG.COM Limited. GG.COM Limited does not control in any respect any information, products or services offered by such other websites and shall not be responsible for the content of such other websites. For example, the Client may be able to buy goods or services via GG.COM, some of which may be through third party retailers who link to the website. The Client may also enter into correspondence with or participate in promotions of advertisers on GG.COM. GG.COM in no way endorses these third parties and any such transactions, dealings, correspondence with or payment for goods and services and any other terms, conditions, warranties or representations associated with such matters are solely between the Client and the third party. GG.COM Limited assumes no liability, obligation or responsibility for any part of any such transaction, dealing, correspondence or participation.

6.  Compliance

6.1  GG.COM Limited shall have the right, but not the obligation, to monitor the content of GG.COM, including community areas, to determine compliance with these terms and conditions and any operating rules established by GG.COM Limited and to satisfy any law, regulation or authorised government request. GG.COM Limited shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on GG.COM.

6.2  GG.COM Limited may terminate the Client's access to the Service immediately without notice if the Client is in breach of any of these terms and conditions or may terminate the Client's access to Premium Pay Services if any charges for these Services are unpaid. In the event of such termination the Client must pay to GG.COM all charges that are due to date for Premium Pay Services supplied to the Client. There will be no refunds for outside tipping services or affiliate tipping services sold via GG.COM. Premium content purchases costing £5 or under will not be refunded. For all other content purchases refunds will be offered on a pro-rata basis. There will be a £5 administration fee charged for all refunds.

6.3  An order confirmation stating Customer's delivery address (if appropriate) and the purchase amount will be sent to the Customer's registered email address immediately after an order for any outside tipping service has been accepted (other than where paid for by SMS).

6.4 These terms and conditions and any claim based on use of this site shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English Courts.

7.  Privacy Policy

7.1  Any personal information relating to the Client which GG.COM Limited receives via GG.COM will be used only for the purposes for which it was received and for any future communications with the Client by GG.COM or by its affiliates or other third parties carefully selected by GG.COM as offering products or services in which the Client may be interested. GG.COM will not otherwise disclose any personal information which it receives in respect of the Client's use of GG.COM to any third party, other than a purchaser of the whole of the business and assets of GG.COM Limited, without the Client's consent except as required by law. If the Client does not wish to receive information about other products or services from either GG.COM, its affiliates or selected third parties then the Client should indicate this in the relevant section of the registration form.

7.2  As required by the Data Protection Act 1998, GG.COM follows strict security procedures and takes appropriate measures to ensure that the Client's personal information is not damaged, destroyed or disclosed without the Client's consent and to prevent unauthorised access to it. However, GG.COM cannot be responsible for and therefore excludes all liability for loss or misuse of personal information which is intercepted or otherwise misused by unauthorised persons.
